This Privacy Policy describes the policies and procedures of Inc. and our affiliates (“we”, “our” or “us”) on the collection, use and disclosure of your information on and any other website on which this Privacy Policy is posted (collectively, the “Site”) and the services, features, content or applications we offer (collectively with the Site, the “Services”). We receive information about you from various sources, including: (i) your use of the Services generally; and (ii) from third party websites and services. When you use the Services, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

1. What Does This Privacy Policy Cover?

This Privacy Policy covers the treatment of personally identifiable information (“Personal Information”) gathered when you are using or accessing the Services. This Privacy Policy also covers our treatment of Personal Information that our business partners share with us or that we share with our business partners.

This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third party websites, services and applications (“Third Party Services”) that you elect to access through the Service or to individuals that we do not manage or employ. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We encourage you to carefully review the privacy policies of any Third Party Services you access.  This Privacy Policy also does not apply to the practices of our customers, or to information about you that we may receive solely as a “service provider” or vendor to those customers.

Your information may be maintained on and transferred to computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, we may transfer personal information to the United States and process it there. By using the Services and submitting your Personal Information you consent to such transfer and storage.

2. What Information Do We Collect?

The information we gather enables us to personalize, improve and continue to operate the Services. In connection with certain aspects of the Services, we may request, collect and/or display some of your Personal Information, as well as other information in connection with your use of, and access to, the Services. We collect the following types of information from our users.

a. Information You Choose to Provide to Us:

We collect information you provide directly to us. For example, if you set up an account, we will require you to provide certain information, such as a phone number and/or email address. You may also decide to provide us with your full name and telephone number, or other contact information and information about yourself and your interests.

b. User Content:

Some features of the Services allow you to provide content to the Services, such as written comments. All content submitted by you to the Services may be retained by us indefinitely.

c. Information Collected Through Our Mobile App(s):

We offer mobile applications (“apps”) through which we collect information in order to provide our Services and related information.  That information may include mobile identifiers as well as personal information that you provide to us, such as your account information, email address, name or professional information and credentials.

d. Information That is Collected Automatically:

When you interact with our Services (including visits to our Site and interaction with emails we may send you), we automatically receive and record information from your web browser. This includes, for instances, your IP address, device information search queries and cookie information. It also includes cookies and similar technical identifiers, that identify your browser or device: we or third parties that we work with (whether as independent companies or as service providers to us) place and read cookies on your browser, along with cookie “identifiers” that identify you as you interact with our website. These third parties may place cookies when you visit other sites, as well. Please see Section 6 below regarding these cookies, and how to opt out of certain marketing uses of cookies.

Similar, we collect other device-specific information if you access the Services using a mobile device. This may include but is not limited to unique device identifiers, network information, and hardware model, as well as information about how the device interacts with our Services.

e. Email Communications:

We may receive a confirmation when you open an email from us.

f. Aggregate Information:

We collect (or create) statistical information about how users, collectively, use the Services (“Aggregate Information”). Some of this information is derived from Personal Information. This statistical information is not Personal Information and cannot be tied back to you or your web browser. We may use the information that we collect about you or that you provide to us, including any Personal Information, (i) in connection with our business; (ii) in any way we may describe when you provide the information; and (iii) for any other purpose with your consent.

g. Information We Receive from Third Parties:

Although the information that we use and share generally comes from our own Services, we may sometimes receive information from, or enhance our own information with, information we receive from third party, data hygiene or validation companies, or data “brokers.”  For instance, we might work with such a vendor to confirm, validate or add information to the consumer profile that we have about you.  (And we might then also share this information as described in Section 5.). In some cases, we might receive information this way from our customers, such as to enhance our services, provide co-marketing or promotional services, or generally to help companies better market to individuals.

h. Information Regarding Your Social Networks:

Occasionally, you can use our Services to interact with your account on other services (“Third Party Account”), such as Facebook or Twitter. In addition to using your Third Party Account credentials to sign in to the Services, you can access posting and sharing tools on the Services, including a “share” button that allows you to post information to your social networks outside of the Services (“Share”). Please note that these tools may be operated by Third Party Services.

By using these tools, you acknowledge that some Third Party Account information may be transmitted to us, and that Third Party Account information transmitted to our Services is covered by this Privacy Policy. Additionally, when you use one of these sharing tools, the Third Party Service that operates the tool may be collecting information about your browser or online activity through its own tracking technologies and subject to its own privacy policy. Lastly, when you use these tools, some of your information from the Services (such as the reservation information you selected to Share) may be shared with the Third Party Service and others. Therefore, we encourage you to read the privacy policies and other policies of the social networks you use in connection with the Services.

3. Information We Receive From Our Customers and Business Partners

We also receive information from our customers and business partners that includes personal information about their own customers, contacts, or other personal information they may provide to us.  This may include (for instance) an individual’s phone number, name, or email address, or information about individuals’ interests (for instance, the type of home or neighborhood they may be interested in purchasing).  Our customers generally act as the “controller” that makes decisions about their own client information.  (Therefore, if you have questions about how our customers collect or use information, those questions should be directed to those customers.)

4. How We Use the Information We Collect or Receive

We may use your information for various purposes, depending on the type of information we have collected from and about you and the specific Services you use, in order to:


  • Respond to your requests for information
  • Provide you with updates and information about our Services
  • Verify your identity and for fraud prevention
  • Process your payments (as explained above, such payments will be processed by our third-party payment processor, not by us)
  • Help us better understand your interests and needs to improve the Services
  • Engage in analysis, research and reports regarding the use of our Services
  • Contact you regarding our (or other parties’) products, services, surveys, or promotions (in accordance with any privacy preferences you have expressed to us)
  • Provide you with recommendations
  • Tailor the content and information that we may send or display to you, retarget content to you through our software application and elsewhere, and to otherwise personalize your experiences while using our Services
  • Tailor advertising or promotions to you when you use the Services or interact with other services, apps or content.
  • Assist other companies in advertising to you or contacting you with offers we think may be suited to your interests, which may occur online, through devices you use (such as mobile phones or browsers), or through direct mail or other channels.
  • Provide, manage and improve the Services, and test and create new products, features and services
  • Understand and resolve any technical and security issues reported on our Sites
  • Comply with the law and protect the safety, rights, property or security of Hive, the Services and the general public
  • Enforce any legal terms that govern your relationship with us or your use of the Services
  • Share it with or sell it to third parties for their own marketing purposes, if we believe you may have an interests in their goods or services.  That marketing may occur across various “screens” or various channels:  for instance, it may be through digital advertising, email advertising, telephone, direct mail, mobile or even TV devices.
  • For any other purpose with your consent


Please note that we may combine information that we collect from you and about you (including automatically generated information) with information that we obtain about you from third parties, and use such combined information in accordance with this Privacy Policy.

Aggregate/De-identified/Anonymous data.

We may aggregate, de-identify and/or anonymize any information collected through the Services so that such information is no longer linked to your personally identifiable information (such as your name, address, phone number or email address). We may use aggregated and anonymized information for any purpose, including, without limitation, for research and marketing purposes.

5. How, and With Whom, Is My Information Shared?

The Services are designed to help you share information with others. As a result, some of the information generated through the Services is shared publicly or with third parties.

a. Public Information About Your Activity on the Services:

Some of your activity on and through the Services is public by default. This may include, but is not limited to, content you have posted publicly on the Site or otherwise through the Services.

b. Information You Elect to Share:

You may access other Third Party Services through the Services, for example by clicking on links to those Third Party Services from within the Site. We are not responsible for the privacy policies and/or practices of these Third Party Services, and you are responsible for reading and understanding those Third Party Services’ privacy policies. This Privacy Policy only governs information collected on the Services.

c. User Profile Information:

User profile information including your username and other information you enter may be displayed to other users to facilitate user interaction within the Services. We will not directly reveal user email addresses to other users.

d. Information Shared with Agents:

We employ and contract with people and other entities that perform certain tasks on our behalf, including our independent contractor licensed real estate salespersons and brokers, that may offer or provide services to you (“Agents”). We may need to share Personal Information with our Agents in order to provide products or services to you. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist in the provision of the Services.

e. Service Providers:

Any information we collect or receive will be shared with service providers that help us to offer, operate and improve our Services. This includes (for instance) entities that provide services related to billing, collections, marketing, data storage, hygiene, processing and enhancement, hosting, tech and customer support, and other operational and security functions.

f. Aggregate Information:

We share Aggregate Information with our partners, service providers and other persons with whom we conduct business. We share this type of statistical data so that our partners can understand how and how often people use our Services and their services or websites, which facilitates improving both their services and how our Services interface with them. In addition, these third parties may share with us non-private, aggregated or otherwise non Personal Information about you that they have independently developed or acquired.

g. Information Disclosed Pursuant to Business Transfers:

In some cases, we may choose to buy or sell assets. In these types of transactions (and due diligence leading up to such transactions), user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party.

h. Information Disclosed for Our Protection and the Protection of Others:

We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce this Privacy Policy and our Terms of Service, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, and those of our users and any other person or entity. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

i. Information We Share with Marketers:

Finally, as also noted in Section 4, we sometimes share or disclose any information we have collected about you with other companies, platforms or marketers who wish to market products or services we or they think would be relevant to you.  This may happen in various ways.  For instance, we may run a co-marketing or co-branding program with another company.  Or, we may simply provide real estate brokers on our platform information about who is viewing or seems interested in their listings.  We similarly may in some cases supplement information that our customers provide to us with information we have collected from you through our Services, (For instance, if we know you often search 2 bedroom apartments, we might share that with a customer that is trying to better market to you), or that we have collected from third parties,  such as data providers or other companies that license information about consumer preferences.

And in some cases, we may share information with trusted businesses we partner with to provide you offers, discounts or information we believe may be pertinent to or desired by you.

We may also share information in other ways, upon your consent or reasonable notice to you.

Please remember that if you choose to provide Personal Information using certain public features of the Services, then that information is governed by the privacy settings of those particular features and may be publicly available. Individuals reading such information may use or disclose it to other individuals or entities without our control and without your knowledge, and search engines may index that information. We therefore urge you to think carefully about including any specific information you may deem private in content that you create or information that you submit through the Services.

6. Your “Opt Out” Choices

We provide you the opportunity to “opt out” of our sale of your personal information.  This will apply to any personal information that we collect and then sell to our customers.  It will not, by contrast, apply to personal information that we handle only as a vendor for our customers.  It also will not apply to information that we provide to our customers to complete a process or request that you initiated – such as request a tour or complete a form that indicates that information will likely be shared with a third party (such as an agent).   If you wish to opt out of our sale of your personal information for marketing purposes, please send your email, telephone number, name and to us at

7. Cookies and Similar Technologies

Cookies are pieces of text that may be provided to your computer through your web browser when you access a website. Your browser stores cookies in a manner associated with each website you visit. We use cookies to enable our servers to recognize your web browser and tell us how and when you visit the Site and otherwise use the Services through the Internet. We sometimes rely on service partners and business partners to deploy and read these cookies, whether on our behalf or in order to operate their own services (which we may then use).

Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. However, turning off cookies may reduce the functionality of some websites and web operations.

This Privacy Policy covers our use of cookies only and does not cover the use of cookies by third parties. We do not control when or how third parties place cookies on your computer. For example, third party websites to which a link points may set cookies on your computer.

We use the following types of cookies:

  • Essential Cookies. Essential Cookies are required for providing you with features or services that you have requested. For example, certain Cookies enable you to log into secure areas of our Services. Disabling these Cookies may make certain features and services unavailable.
  • Functional Cookies. Functional Cookies are used to record your choices and settings regarding our Services, maintain your preferences over time and recognize you when you return to our Services. These Cookies help us to personalize our content for you, greet you by name, and remember your preferences (for example, your choice of language or region).
  • Retargeting/Advertising Cookies. Retargeting/Advertising Cookies collect data about your online activity and identify your interests so that we can provide advertising that we believe is relevant to you. For more information about this, please see Section 7 below.

8. Cookies and Similar Technologies

a. Targeted Online Advertising.

We allow third-party ad networks, including third-party ad servers, ad agencies, ad technology vendors and research firms, to serve advertisements through the Services. These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors (“Interest-Based Ads”). Information for Internet-Based Ads (including Personal Information) may be provided to us by you, or derived from the usage patterns of particular users on the Services and/or services of third parties. Such information may be gathered through tracking users’ activities across time and unaffiliated properties, including when you leave the Services. To accomplish this, our service providers may deliver cookies, including a file (known as a “web beacon”) from an ad network to you through the Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Web beacons allow ad networks to view, edit or set their own cookies on your browser, just as if you had requested a web page from their site. (We describe “cookie” technologies in greater detail in Section 6 above.

Through the DAA and Network Advertising Initiative (“NAI”), several media and marketing associations have developed an industry self-regulatory program to give consumers a better understanding of, and greater control over, ads that are customized based a consumer’s online behavior across different websites and properties. As described in Section 6, you may also “opt out” of our sale of your personal information by sending us your name, telephone number and email address at

Please also note that you can opt out of your sale of other personal information about you, in other circumstances, by using the “opt out” method we provide in Section 3 above.

9. Is Information About Me Secure?

We seek to protect Personal Information to ensure that it is kept private; however, we (like any company operating online) cannot guarantee the security of any information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. We therefore cannot guarantee or warrant that any techniques we use (no matter how sophisticated) will in all cases prevent unauthorized access to information about you that we store, Personal Information or otherwise.

10. What Happens When There Are Changes to this Privacy Policy?

We may amend this Privacy Policy from time to time, by posting it to the website with a new “update” date. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected. If we make material changes in the way we collect or use information, we will provide reasonable notice by either sending an email to affected users or by linking to the new Privacy Policy in a prominent manner (such as in a prominent color or font). A user is bound by any changes to the Privacy Policy when he or she uses the Services after such changes have been first posted.

For instance, the California Consumer Privacy Act (CCPA) does not currently apply to us, as we are covered by one or more exemptions under that Act.  The same is true of several other state privacy laws, either because we do not collect significant information from those states’ residents or because we fall under other “small business” exemptions.  But if and when our practices fall under that statute’s coverage, we will make applicable changes to this Privacy Policy.
